Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Modernaut LLC (“Modernaut,” “we,” “us”) governing the Chillswitch mobile application, website, and related services. By accepting these Terms in the app or using the services, you agree to them and to the Privacy Policy. If you do not agree, do not use Chillswitch.

Not an emergency service

Chillswitch is a voluntary check-in and notification tool. It is not emergency services, a monitoring center, medical care, legal advice, or a substitute for calling for help. A missed check-in means only that a person has not confirmed. It does not establish that the person is injured, unsafe, or in distress.

Notifications can be delayed, filtered, silenced, duplicated, or missed because of connectivity, devices, batteries, permissions, operating systems, Apple, Google, Twilio, mobile carriers, hosting providers, or recipient action. Contacts may not see or act on an alert. Maintain an independent safety plan appropriate to your circumstances. If you are in immediate danger, contact local emergency services.

Eligibility and voluntary participation

You must be at least 13 and legally able to agree to these Terms. If you are below the age of legal majority where you live, obtain permission from a parent or legal guardian where required. Chillswitch is not directed to children under 13.

Do not add, monitor, or control another person through deception or coercion. Circle membership, mutual coverage, response teams, and guardian/dependent interval agreements require the choices presented in the product. Relationship labels grant no legal authority. Participants may leave or end voluntary arrangements as the product permits.

Accounts and recovery

You are responsible for your device, credentials, recovery kit, and activity under your account. Account creation does not require an email address or phone number, so Modernaut cannot perform an ordinary email password reset. Keep your recovery code separate from your phone. Anyone who obtains your device, credentials, or recovery kit may be able to access your account.

Alerts, contacts, and SMS

Configure schedules, grace periods, recipients, and disclosures carefully and review them regularly. In-app alert content is sealed on the sending device, but routing and delivery depend on the service and providers. Tapping a notification action may open the app and protected accounts still require verification.

SMS is available only where enabled and supported. Entering another person’s number is not that person’s consent. Automated SMS alerts require the recipient to enroll by replying YES or START with an issued code. Frequency varies; message and data rates may apply. Reply STOP to opt out and HELP for help. SMS is not end-to-end encrypted and is processed by Modernaut, Twilio, mobile carriers, and recipient devices.

Subscriptions and purchases

The core free plan and current paid-plan allowances are described on the Pricing page. Optional Individual and Household subscriptions, when available, are sold through Apple or Google. The store displays the final localized price, billing period, and any trial or introductory terms before confirmation. Organization plans are contracted directly with Modernaut LLC rather than sold through the app stores, and are governed by separate written terms.

Store subscriptions automatically renew unless canceled through the applicable Apple or Google account within the period required by that store. The store charges the payment method associated with your account. Manage or cancel through the store; deleting the app or your Chillswitch account does not cancel a subscription. Refunds, billing disputes, renewal timing, and store-account changes are subject to the store’s rules and applicable law. Restore Purchases is available for eligible purchases.

If a paid entitlement ends, the current service keeps existing configuration but may prevent additions beyond the free allowance. Plan status does not increase delivery priority or make an active alert more reliable. Features, allowances, and prices may change prospectively with notice required by applicable law; changes do not alter a store term already purchased except under store rules.

Acceptable use

• Do not use Chillswitch to stalk, coerce, deceive, harass, threaten, or unlawfully monitor another person.

• Do not forge alerts or all-clears, interfere with another person’s escalation, or impersonate another user.

• Do not send unlawful or non-consensual messages, evade STOP requests, or enter numbers you are not authorized to use for an invitation.

• Do not attack, probe without authorization, overload, scrape, reverse engineer where prohibited, or circumvent access, rate, billing, safety, or abuse controls.

• Do not use the service in violation of law or another person’s rights.

Your content

You retain rights in content you provide. You grant Modernaut a limited license to host, process, transmit, and display it only as needed to operate, secure, and support the service and comply with law. Do not provide content you lack the right to use. Client-side encryption applies only to the categories described in the Privacy Policy and does not make SMS private.

Suspension, deletion, and service changes

You may delete your account through Settings. Deletion does not cancel a store subscription. We may restrict or terminate access to protect users, comply with law, address abuse, nonpayment, or security risk, or discontinue the service. Where practicable and lawful, we will provide notice of material changes affecting service availability. We do not promise uninterrupted operation or indefinite availability of any feature.

Intellectual property

Chillswitch, its branding, and service materials are owned by Modernaut or its licensors and are protected by applicable law. Any source code made available separately is governed by the license accompanying that code. These Terms do not grant rights to Modernaut trademarks.

Disclaimers

To the fullest extent permitted by law, the services are provided “as is” and “as available.” Modernaut disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, error-free, or suitable as your only safety measure. Some jurisdictions do not allow particular disclaimers, so they may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Modernaut and its officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or opportunity, arising from the services, including delayed or failed notifications. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

Governing law and disputes

Applicable law, jurisdiction, and mandatory consumer protections may depend on where you live and where Modernaut LLC is organized. Nothing in these Terms waives rights that cannot legally be waived. Any dispute must be brought in a court with lawful jurisdiction unless the parties agree to another permitted process.
